Policies

By completing a payment via minisessionbookingkimberlindawnphoto.com you are agreeing to the policies listed below. 

Retainer- Payments: 

To book a session with Kimberlin Dawn Photography and to secure a session date, a non-refundable retainer must be paid in full. No session date is reserved until retainer fee is received. Retainer is good for up to 6 months from the original date of booking unless otherwise mentioned. The remaining balance is due one week prior to the session taking place. After services are rendered the final payment is non-refundable, no exceptions. 

Late fee- No shows: 

The session will begin and end according to the session start and end time as agreed upon by the client and the photographer. If the client does not arrive at the specified start time, session time will be shortened and cannot be made up. If the client fails to attend the session without contacting the photographer prior to the session start time, all payments made become non-refundable and a new retainer will have to be made to reschedule, no exceptions. 

Reschedule- Cancellations: 

In the event the client must cancel the contracted services for photography on this contract, and balance is paid prior to the event/session date the Photographer agrees to hold the balance towards a future session to be completed within six months. 

Editing Of images:

Kimberlin Dawn Photography holds full rights to choosing the images, editing of the images, and is not liable for any poses. The client shall assist and cooperate with the photographer in obtaining the desired photographs including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the photographers direction; pre-shoot consultations; etc. Photographer should not be responsible for photographs not taken as a result of clients failure to provide reasonable assistance or cooperation.

Digital files + Print Release: 

It is agreed that dual ownership of all photography files will be maintained by the client and Kimberlin Dawn Photography. Upon delivery of the digital files to client's physical control, the client shall gain personal non-commercial rights to images. It is also agreed that Kimberlin Dawn Photography will have full rights to use all images for advertising purposes or commercial use. Kimberlin Dawn Photography does not guarantee archival of digital files passed a period of three months after session date and will not be responsible if loss occurs per section one.

Liability:  Although extreme care will be taken of the files, Kimberlin Dawn Photography limits any liability for loss, damage, or failure to deliver images for any reason of Photographers non-performance caused by any force or similar circumstances, illness, accident, or any cause beyond their control. In any event, the limit of Kimberlin Dawn Photography liability shall not exceed the contract price stated herein. 

Delivery:

Photography mini session promises 15  digital images on a online gallery free to download, additional digital images/prints are able to be purchased for $25.00 per digital image or entire gallery discounted at Kimberlin dawn photography current rate. 

Copyright- Social Media: 

Kimberlin Dawn Photography retains copyright to the photographs, and hereby grants the client unlimited but non-exclusive rights to use or reproduce the photographs for which the client pays. IF client post to social media, images taken by Kimberlin Dawn Photography client must give proper credit in caption associated with picture along with tagging Kimberlin Dawn Photography Social media page. If client fails to give credit, images must be removed. No alterations/filters or editing of any sort are to be added to Kimberlin Dawn Photography images by the client, as it interferes with Kimberlin Dawn Photography Copyright. I understand that Kimberlin dawn photography owns full copyright to the images.
